Code Compliance

Code Compliance Officer is defined by the Texas Department of Health, which regulates and sets standards for code enforcement. There are currently two Code Enforcement Officers for the City of Pflugerville. 

Code Compliance is the inspection, improvement and rehabilitation of environmental hazards in public and private premises by determining the presence of fire or health hazards, nuisance violations and unsafe building conditions. The City enforces its standards and requirements through the Pflugerville Code of Ordinances.

There are two common areas receiving code enforcement complaints on a daily basis.

Junked VehicleJunked Vehicles
A junked vehicle fits the following characteristics:

  • An automobile unable to run under its own power
  • Is totally or partially wrecked, dismantled, or discarded
  • Is parked for 15 to 30 consecutive days without moving
  • Located any place visible from a public place or public right-of-way
  • Is detrimental to the safety and welfare of the general public, tending to reduce the value of private property, to invite vandalism, to create fire hazards and to damage the economic welfare of the City

JunkNuisance Ordinance
A public nuisance is defined in Pflugerville’s Code of Ordinances as any act, thing, occupation, condition, or use of property that is of such a nature and continues long enough to:
  • Substantially annoy, injure or endanger the comfort, health, repose or safety of the public
  • Greatly offend the public morals or decency
  • Unlawfully and substantially interfere with, obstruct, or tend to obstruct or render dangerous for passage, any street, alley, highway, navigable body of water or other public way

Certain laws and court rulings protecting all citizens’ right to privacy and the code enforcement officer’s actions may be limited. In witnessing a violation, court rulings require the violation be in plain view of the officer's sight. Violations hidden from view, require the property owner's or occupant’s permission for the officer to inspect, or the officer must obtain a search warrant based on reasonable knowledge of the alleged violation.

Complaints, Inspections and Notices
All complaints alleging the existence of a public nuisance must be filed with the Code Enforcement Officers. The officers will respond promptly to inspect the premises and make a written report on the findings of the inspection. Whenever practical, photographs of the premises will be attached to the written report.

If the Code Compliance Officer determines there is no public nuisance presenting a danger to the public health, safety, and welfare, the complainant may present its case to the City of Pflugerville Municipal Court. The complainant must comply with all rules of the court including payment of filing fees sufficient to cover court costs. The complainant bears the burden of proof in any case before the court.
